  قاعدة «العقود تابعه للقصود» از قواعد پرکاربرد فقهی در مباحث مرتبط با عقود و ایقاعات است. در این مقاله سعی شده گزارشی نسبتاً کامل از این قاعده ارائه گردد و همچنین پیشینة این قاعده در کلام متقدّمین برای علاقه‌مندان روشن‌تر شود.

  The rule “contracts are subordinate to intentions” is one of the commonly used jurisprudential rules in the subjects relevant with contracts and unilateral obligations. In this article, we have tried to present a fairly complete report of this rule and also to clarify the background of this rule in the old related literature for those interested.
