سفارش ساخت «استصناع»

چکیده

«استصناع‏» یعنی فروش به سفارش که در این پیمان یا قرارداد، فروشنده متعهد به ساخت و تحویل کالایی مطابق سفارش خریدار می‏گردد و عقد بیع یا مواعده، در همان زمان سفارش منعقد می‏شود.
نوشتار پیش رو، عهده‏ دار بررسی این مسئله بر اساس موازین فقهی است، تا از این رهگذر جایگاه و ارزش این دادوستد بیان شود و با روش مقارن، موضع فقهای مسلمان در این باره روشن گردد. مقاله از دو بخش «موضوع شناسی» و «بررسی فقهی مسئله» تشکیل شده است.

چکیده [English]

((Istesna')) means to sell by order under an agreement or contract in which the seller undertakes to manufacture and deliver a ware based on the buyer's order, and the contract of sale or mutual promise is concluded at the time of ordering.
     This writing is to study this matter based on jurisprudential criteria, so that the position and value of this kind of sale along the position of jurisprudence in this regard is discussed comparatively. This article is composed of two parts: understanding the subject and jurisprudential study of the matter.
