Discussing about factors of intensifying a penalty in Islamic penal system is of significant importance. Because determining a proportional penalty to committed crime causes the observance of humane and Islamic principles, like rule of criminal justice, and the proportion of crime and penalty. It provides more mental health for society. Repeating crime is one of general reasons of intensifying a penalty. It is highly effective in achieving goals of penalty, and prevents a criminal from committing the crime again.Determining the necessary conditions for repeating crime and the limits of intensification demonstrates the topic to be doubly important. Because, if, by mistake, the penalty is more or less than the crime, it will cast dout on the rule of criminal justice, and distinguishing it clearly needs a true research.
